Terms of Service

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

We do not knowingly collect personal information from children under 13. If we learn that a user is under 13 without verifiable parental consent, we will promptly delete that account.

You may register with an email address or a supported third-party login provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must provide accurate, current, and complete information when registering. We reserve the right to suspend or terminate accounts that contain false or misleading information.

You may not transfer your account to another person or use someone else's account without their permission. Notify us immediately at team@wekos.app if you suspect unauthorized use of your account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable federal, state, or local law
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use bots, scrapers, or automated tools to access or extract content from the Service
• Introduce viruses, malicious code, or anything that disrupts or damages the Service
• Reproduce, resell, or create derivative works from our content without written permission
• Impersonate any person or entity or misrepresent your affiliation

We reserve the right to investigate and cooperate with law enforcement regarding any suspected violation of law or these Terms.

All content on the Service — including course sentences, audio recordings, slang cards, graphics, interface designs, logos, and text — is owned by Wekos or its licensors and is protected by United States and international intellectual property law.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service solely for your own personal, non-commercial language learning purposes. You may not reproduce, distribute, modify, publicly display, or create derivative works from any part of the Service without our prior written consent.

Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

The Service integrates with third-party providers including Supabase (authentication and data storage) and Resend (transactional email). We are not liable for the availability or practices of these services. Your use of them is subject to their respective terms.

The Service may contain links to third-party websites. We do not control, endorse, or assume responsibility for any third-party content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC LEARNING OUTCOMES WILL BE ACHIEVED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WEKOS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE SUM OF $100. USERS ON THE FREE TIER ARE NOT ENTITLED TO ANY MONETARY DAMAGES FROM US.

You agree to indemnify, defend, and hold harmless Wekos and its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide advance notice of material changes to the Service.

We may update these Terms at any time. The revised Terms will be effective upon posting to this page. We will notify you of material changes by email or in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California and the federal laws of the United States, without regard to conflict of law principles.

Before filing a formal legal claim, you agree to first contact us at team@wekos.app and give us 30 days to attempt an informal resolution.

If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English. You waive any right to bring or participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wekos regarding the Service and supersede all prior agreements or understandings.

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

Our failure to enforce any right or provision of these Terms shall not be a waiver of that right. We may assign these Terms at any time; you may not assign them without our prior written consent.
